Terms & Conditions
Effective date: 1 February 2026
Business: Shamarie Flavel / Evolve Courses (update business details as needed)
1. Acceptance of Terms
By purchasing, accessing, or using the QSU Membership (“Membership”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not purchase or use the Membership.
2. What the Membership Includes
The Membership provides ongoing access (while your subscription is active) to the QSU member area, which may include digital trainings, audios/meditations, teachings, member posts, live or recorded sessions, downloads, and/or community spaces (“Content”).
Content, features, and inclusions may evolve over time to keep the Membership current.
3. Eligibility & Account Responsibility
You must provide accurate purchase and account details and keep your login secure. Your membership access is for your personal use only. Sharing logins, re-selling, or redistributing Content is not permitted.
4. Payment, Billing & Renewals
-
Membership is offered on a recurring subscription basis (e.g., monthly or annual), billed in advance.
-
By purchasing, you authorise recurring billing until you cancel.
-
If a payment fails, access may be paused until payment is successfully processed.
5. Cancellation, Pausing & Access After Cancellation
-
You may cancel anytime via your Kajabi account settings (or by contacting support if you cannot access your account).
-
Once cancelled, your access typically continues until the end of the current paid period, then ends.
-
Any “pause” option is at the business’s discretion (if offered), and may not be available for all plans.
6. Refund Policy (Change of Mind)
Unless required by law, change-of-mind refunds are not provided for Membership payments already made. Please choose carefully.
If you believe you were charged in error, contact support promptly.
7. Australian Consumer Law (ACL) Notice
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
8. Content Release Schedule (General)
We aim to deliver content and/or live elements on a regular rhythm (see the published Membership schedule), however exact timing, formats, and topics may change due to creation flow, platform updates, or facilitator availability.
9. Intellectual Property & License
All Content is owned by Shamarie Flavel / Evolve Courses (unless otherwise credited) and is protected by copyright and intellectual property laws.
You receive a limited, non-transferable, revocable license to access the Content for personal use during an active subscription. You may not:
-
copy, reproduce, distribute, sell, or publicly share the Content,
-
record or redistribute live sessions (unless explicitly allowed),
-
remove watermarks/copyright notices.
10. Community Guidelines (If a Community is Included)
If the Membership includes a community space, you agree to:
-
engage respectfully (no harassment, hate speech, or targeted personal attacks),
-
keep other members’ shares confidential,
-
avoid medical/legal claims, coercive advice, or predatory marketing.
We reserve the right to remove posts or revoke access (without refund for change-of-mind) for serious or repeated breaches.
11. Disclaimer (Wellbeing / Educational Nature)
The Membership is complementary in nature and for educational and personal development purposes. It is not medical, psychological, legal, or financial advice, and does not replace support from your preferred qualified professionals. You remain responsible for your choices, wellbeing, and outcomes.
12. Results & No Guarantees
Every person’s experience is different. We do not guarantee specific results, outcomes, or earnings.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from your use of (or inability to use) the Membership. Nothing in these Terms limits your rights under the Australian Consumer Law.
14. Changes to Terms or Pricing
We may update these Terms or adjust pricing/inclusions from time to time. If changes are material, we will provide notice via email or inside the member area. Existing members retain access according to their current subscription terms until renewal, unless otherwise stated.
Community Guidelines
The QSU community is a sanctuary space for learning, reflection, and respectful connection. By participating in the community (posts, comments, live calls, chat, or messages), you agree to the following:
1) Be respectful and kind
-
Speak to others with courtesy and care.
-
No bullying, harassment, intimidation, discrimination, hate speech, or personal attacks.
-
No shaming, mocking, or aggressive “calling out.”
2) No unsafe or coercive conduct
-
No threats, doxxing, stalking, or targeted harassment.
-
No manipulation, coercion, or pressuring others to adopt your beliefs, practices, or worldview.
3) Confidentiality matters
-
Do not share or screenshot other members’ stories, names, or posts outside the group.
-
If you refer to someone else’s share, do so anonymously and with respect.
4) Keep it supportive, not clinical
This space is educational and complementary. Please don’t:
-
diagnose others, prescribe treatments, or present medical/psychological advice as certainty,
-
pressure someone to stop prescribed care,
-
make promises or guarantees about outcomes.
If you’re concerned for someone’s safety, encourage professional support.
5) No spam or unsolicited selling
-
No promotional posts, affiliate links, “DM me for my services,” or recruitment unless Shamarie explicitly invites it.
-
If collaboration opportunities arise, ask first.
6) Respect the container
-
Stay on-topic where possible.
-
Use content warnings if discussing heavy material (e.g., grief, trauma, abuse).
-
If asked to pause or soften a thread, please honour that.
Moderation, Removal & Membership Forfeit
We reserve the right to moderate the community to protect the safety and integrity of the space.
If these guidelines are breached, we may take one or more of the following actions (at our discretion):
-
remove content (posts/comments),
-
issue a warning,
-
temporarily suspend community access, and/or
-
terminate membership access immediately for serious misconduct or repeated breaches.
No-refund clause for removal
If membership is terminated due to guideline breaches, your membership will be forfeited and no refund will be provided for the current billing period, unless required by law (including under Australian Consumer Law).
Examples of behaviour that may result in immediate removal: harassment, hate speech, threats, repeated personal attacks, doxxing, or persistent disruptive conduct after warnings.
